Privacy Policy

1. General Provisions

1.1. This Privacy Policy (hereinafter referred to as the Policy) applies to all information that QRCHIK LLC (hereinafter referred to as QRCHIK) receives about an individual during the use of QRCHIK programs and products, the provision of QRCHIK services, as well as during the execution by QRCHIK of any other agreements or contracts aimed at providing services to an individual (hereinafter referred to as the User).

1.2. QRCHIK is a company that provides services for providing access to software in electronic form, provided for by the functionality of the QRCHIK Service.

1.3. Use of QRCHIK services means the User’s unconditional consent to this Policy and the conditions for processing information about the User specified therein. In case of disagreement with these conditions, the User must refrain from using QRCHIK services.

1.4. QRCHIK has the right to unilaterally make changes to this privacy policy and inform the User through information messages through all communication channels.

2. Information about Users that QRCHIK receives and processes

2.1. In order to provide payment and other services to Users, QRCHIK receives and processes the following information:

2.1.1. Information that the User entered independently into the QRCHIK Service at any stage of interaction with the Service:

FULL NAME;

floor;

Date of Birth;

residential address;

serial number of the passport and its expiration date;

personal identification number of an individual;

passport photo and/or selfie (user photo);

contact phone number;

bank card number and expiration date.

2.1.2. Data about all stages of interaction with the QRCHIK Service, received automatically from the device from which the QRCHIK Service is accessed, including, but not limited to:

2.1.2.1. Information about phone numbers from the device’s address book (used to facilitate Users’ transactions of money transfers, accounting for these transactions, etc.)

2.1.2.2. Information about the location of the User’s device (based on data from the cellular operator’s network and GPS signals, used to inform about additional services available to the user and determined by his location, collect analytics on the use of the application depending on location, etc.)

2.1.2.3. Photo images obtained using the camera and stored in the device’s memory (for filling out a profile, identification, reading QR codes, etc.)

2.1.2.4. Information about the User's mobile device, such as mobile device model, operating system version, unique device identifiers, as well as mobile network data and mobile phone number

2.1.2.5. Information about transactions performed, such as the place, time and amount of transactions performed, type of payment method, information about the seller and/or service provider, as well as other information related to the above transactions

2.1.3. Data about the User obtained within the framework of agreements concluded by QRCHIK with third parties for the purpose of providing services to Users by QRCHIK or third parties.

2.2. By using any Service provided by QRCHIK, the User agrees that QRCHIK may use the data for subsequent processing by automated systems, and may receive and transfer to QRCHIK's counterparties and Partners to provide services to Users.

By accepting this information, QRCHIK assumes that this information was obtained legally and its transfer to QRCHIK was carried out with the permission of the individual.

2.3. QRCHIK guarantees that any third party (QRCHIK's counterparties and Partners) gaining access to User data obtained in accordance with this Policy will ensure unconditional compliance with the terms of this Policy and the protection of user data in accordance with this Policy.

2.4. QRCHIK may receive publicly available information when the User uses third-party resources.

2.5. QRCHIK does not have the ability to verify the legal capacity of an individual, and also does not verify the information provided by an individual. QRCHIK assumes that the individual has provided sufficient, reliable and current information about himself.

3. Purposes of collecting and processing personal information of Users

3.1. QRCHIK collects and stores only that personal information that is necessary to provide QRCHIK Services or fulfill agreements with the User, except in cases where the law requires the mandatory receipt and storage of certain personal information. Personal information is stored no longer than required by the purposes of processing, unless the storage period for such personal information is established by the legislation of the Republic of Uzbekistan, the Policy on the User’s Use of QRCHIK Services.

3.2. QRCHIK may use the User’s personal information for the following purposes:

3.2.1. Execution of agreements with QRCHIK, as well as agreements concluded with counterparties and Partners of QRCHIK, including for the purpose of identifying/simplified identification of the User, providing the User with the opportunity to use all available QRCHIK services;

3.2.2. Providing payment services to Users, including other Services provided by the Company;

3.2.3. Carrying out scoring and analysis of the User's solvency;

3.2.4. User identification;

3.2.5. Communication with the User, processing incoming requests from Users, including the subsequent transfer of such requests and applications for execution to the Company’s counterparties;

3.2.6. Identification of Users in accordance with the Law on Payments and Payment Systems and other acts of legislation and regulations, in accordance with which the Company is entrusted with the corresponding powers and responsibilities;

3.2.7. Taking measures to combat money laundering, terrorist financing and proliferation financing, including due diligence and client identification;

3.2.8. Identification and (or) prevention of conditions conducive to the commission of actions using the QRCHIK Service that are contrary to the requirements of the law and this Policy;

3.2.9. Offering Users personalized Company Services;

3.2.10. Conducting statistical and other studies based on anonymized data;

3.2.11. Carrying out marketing campaigns for clients, including for the purpose of distributing offers to participate in promotions initiated by the Company jointly with counterparties and receiving prizes/rewards provided for by the promotion;

3.2.12. Distribution of advertising and information materials, including targeting of advertising materials and other information brought to the attention of clients;

3.2.13. Improving the quality of the Company’s services, ease of use, and developing new Company services.

4. Procedure and conditions for processing, storage and transfer of personal data

4.1. QRCHIK takes necessary and sufficient organizational and technical measures to protect the User’s information from unauthorized or accidental access, destruction, modification, blocking, copying, distribution, as well as from other unlawful actions of third parties.

In particular, QRCHIK is constantly improving the way it collects, stores and processes data, including physical security measures, to counter unauthorized access to QRCHIK systems for the purpose of property theft, phishing and other types of fraud. QRCHIK also restricts the access of its employees, contractors and agents to User information through strict contractual confidentiality obligations, the violation of which is subject to penalties and penalties.

4.2. QRCHIK has the right to transfer personal data to third parties in the following cases:

4.2.1. Subject to the User's consent.

4.2.2. The transfer is necessary to provide the User with payment services, QRCHIK Services, as well as Services of QRCHIK partners and contractors.

4.2.3. Transfer of information to QRCHIK partners, including affiliates, within the framework of joint projects;

4.2.4. The transfer of information to third parties is necessary for the proper performance by QRCHIK of an agreement or contract with that individual;

4.2.5. transfer of information to third parties providing support for QRCHIK services to the extent necessary to provide such technical support;

4.2.6. the transfer is provided for by the legislation of the Republic of Uzbekistan;

4.2.7. the transfer occurs as part of the sale or other transfer of a business (in whole or in part), and all obligations to comply with the terms of this Policy are transferred to the acquirer;

4.2.8. in order to ensure that the rights and legitimate interests of QRCHIK or third parties can be protected in cases where QRCHIK has reasonable grounds to believe that an individual is violating the requirements of applicable law.

4.2.9. Data obtained from publicly available sources.

4.3. As part of the QRCHIK.ID service, QRCHIK, with the consent of the user, transfers to an external system integrated with the QRCHIK.ID service, selfies and passport data of the User (full name, PIN, date of birth, photograph, gender; series, number, date of issue and expiration of passport ) for the purpose of identification and provision of services to the User in an external system.

4.4. In this case, third parties undertake to comply with the terms of this policy.

4.5. Also, if there are agreements with third parties, the third party has the right to entrust the processing of personal data to QRCHIK in the following cases:

4.5.1. the presence of the User’s consent in writing, including in the form of an electronic document;

4.5.2. if the decision is made in pursuance of an agreement between a third party and the subject of personal data or fulfillment of the terms of a previously concluded agreement;

4.5.3. provided for by law.

4.6. QRCHIK has the right to distribute and/or provide third parties with access to information about an individual without any restrictions after processing the relevant information, which entailed the removal of information that allows the identification of an individual (depersonalization of information), as well as after statistical processing of this information.

4.7. QRCHIK has the right to use information about an individual for the purpose of analyzing the interests and preferences of its audience, adapting QRCHIK’s services according to the results obtained from the above analysis, as well as for advertising purposes on the Internet to the extent necessary for its display to the target audience.

5. Rights and obligations of the User

5.1. The user has the right:

5.1.1. know that QRCHIK, as well as third parties, have personal data and their composition;

5.1.2. receive upon request information about the processing of personal data from QRCHIK;

5.1.3. receive information about the conditions for providing access to your personal data from QRCHIK;

5.1.4. contact an authorized government agency or court regarding the protection of rights and legitimate interests in relation to your personal data;

5.1.5. give consent to the processing of your personal data and withdraw such consent, except in cases provided for by the Law “On Personal Data”;

5.1.6. give consent to QRCHIK, as well as to a third party, to distribute your personal data in publicly available sources of personal data;

5.1.7. require QRCHIK to temporarily suspend the processing of your personal data if the personal data is incomplete, outdated, inaccurate, illegally obtained or is not necessary for the purposes of processing.

5.1.8. independently manage personal data received from QRCHIK? including transfer of data to third parties.

5.2. The User's right to access data processed by the QRCHIK Company is confirmed by the User's request to the QRCHIK Company. QRCHIK has the right, when identifying the User and if there are doubts regarding the identification of the User, to request from the User additional information necessary for the true identification of the User.

User data that is made publicly available by the User or obtained from a publicly available source shall not be provided to the User upon his request.

Consideration of the User's request is carried out within 30 calendar days and this period may be extended taking into account the complexity of its processing.

5.3. The disposal of personal data of a subject recognized as incompetent or limited in legal capacity is carried out by his legal representative.

5.4. The duty of the subject is to provide his personal data in order to protect the foundations of the constitutional system of the Republic of Uzbekistan, morality, health, rights and legitimate interests of citizens of the Republic of Uzbekistan, ensuring the defense of the country and the security of the state

6. Changing and deleting data

6.1. Withdrawal of consent to the processing of personal data is carried out by the User by sending a written request to delete personal data by email support@QRCHIK.uz indicating personal data to identify the User.

QRCHIK has the right, when identifying the User and if there are doubts regarding the identification of the User, to request from the User additional information necessary for the true identification of the User.

In this case, the User may have limited access to the QRCHIK Services due to the inability to identify the User.

6.2. After fulfilling the User’s request to delete personal data, QRCHIK completely and irrevocably anonymizes the User’s personal data.

6.3. In the event of a request to delete personal data, the following rules apply:

6.3.1. QRCHIK may retain some of your personal data as part of QRCHIK's legitimate business interests, including to combat fraud and improve security.

6.3.2. QRCHIK has the right to store and use your personal data to the extent necessary to comply with legal requirements;

6.3.3. Information that you have shared with others (for example, reviews, forum posts) may remain publicly available even after your data is deleted, and your attribution will be removed. Some copies of your information may be retained in our database without any possibility of personal identification;

6.3.4. In connection with the implementation of a protection system against accidental or intentional damage or loss of data, backup copies of your personal data will be deleted with a certain delay.

7. Other conditions

7.1. QRCHIK has the right to offer the User to change and/or supplement this Policy by publishing the Agreement in a new edition. The User's acceptance of such an offer constitutes conclusive actions to use any of the QRCHIK Services under new conditions.
